COMPETITION RULES - FURY CHALLENGE

Your participation in Fury Challenge is conditioned on your acceptance of the terms set forth in these Challenge Rules (“Rules”).  By entering Fury Challenge (by clicking "ACCEPT" below or competing in the Fury Challenge weekend games), you are agreeing to these Rules and confirming your eligibility to enter Fury Challenge in accordance with these Rules.  If you do not agree to the terms of these Rules or if you do not meet the eligibility requirements, you must not compete in Fury Challenge and when offered a choice, select "DECLINE", in which case you will be prevented from participating in Fury Challenge.

1. Eligibility

Fury Challenge is open only to legal residents of the United States (excluding Maryland and Vermont), Canada, Australia, New Zealand, the United Kingdom, Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Italy, the Netherlands, Norway, Portugal, Spain, Sweden , Switzerland and Russia (“Eligible Locations”) who are at least 14 years of age as of 15 September, 2007.  If you are not a legal resident of an Eligible Location or if you are 13 years of age or younger as of 15 September, 2007, you are not eligible to enter Fury Challenge.

If you are a minor in your jurisdiction of residence, then, prior to participating in Fury Challenge, a parent or legal guardian must submit to Auran Games Pty Ltd (ABN 73 081 393 311), the Fury Challenge sponsor (“we”, “us” or “Auran”), at the address and contact details below, a signed, written acknowledgement of their acceptance – on their and your behalf – of these Rules.

You also are not eligible to enter Fury Challenge if the laws of any jurisdiction within an Eligible Location of which you are a legal resident prohibit us from offering or running Fury Challenge, or awarding any prize, in that jurisdiction.  Void where prohibited by law.

Auran employees and their families, and the employees of Auran affiliates, are permitted to enter Fury Challenge but cannot win prizes of any nature. Affiliates include any company involved in publishing, distributing, marketing, hosting, testing, operating or supporting Fury Challenge

We reserve the right to suspend your access to and participation in Fury Challenge if your eligibility is in question, if you have been disqualified or if you fail to comply with these Rules, the End User License Agreement or the Terms of Use.

2. Contest Period

Fury Challenge will occur over two periods.  The first contest period will commence on 28 September, 2007 at 12:01pm American Pacific Standard Time (APST -- UTC - 8) and continue through and until 30 September, 2007 at 11:59pm APST (the “First Contest Period”).  The second contest period will commence on 5 October, 2007 at 12:01pm APST and continue through and until 7 October, 2007 at 11:59pm APST (the “Second Contest Period”).  Collectively, the First Contest Period and Second Contest Periods are the “Contest Period.”  We may shorten or lengthen the Contest Period at our discretion, by providing notice on www.furychallenge.com. houten garagedeuren

3. Practice Periods

Prior to the Contest Period, there will be a practice session for Fury Challenge (the “Practice Session”).  The Practice Session will commence on 14 September, 2007 at 12:01pm APST and continue through and until 20 September, 2007 at 11:59pm APST.  We may shorten or lengthen the Practice Session at our discretion, by providing notice on www.furychallenge.com.

During the Practice Session, we will operate all 7 Ladders (as defined in clause 5 below).  At the end of the Practice Session, the Ladders will be wiped clean and match outcomes during the Practice Session will not count or be applied toward determining winners of Fury Challenge.  Winners of Fury Challenge will be based solely on your performance during the Contest Period, in accordance with clauses 5 and 6 of these Rules.

In addition to the Practice Session, if you have pre-ordered Fury, either directly from us or from an authorised distributor, then, subject to our ability to confirm your pre-order, we will grant you access to Fury during (a) the period between the end of the Practice Session and the beginning of the First Contest Period and (b) the period between the end of the First Contest Period and the beginning of the Second Contest Period (such periods, the “Mid-week Practice Periods”).  The servers may be taken offline for maintenance without notice during these periods.

During Mid-week Practice Periods, we will not operate any Ladders. However, player skill ratings and performance will continue to be updated. In addition, abilities unlocked and items obtained will be usable during the Contest Period. Winners of Fury Challenge will be based solely on the match outcomes during the Contest Period, in accordance with clauses 5 and 6 of these Rules.  Therefore, playing Fury during the Mid-week Practice Periods will provide you with the opportunity to advance your character and otherwise familiarize yourself with Fury.  We may, but have no obligation to, grant other categories of players access to Fury during the Mid-week Practice Periods. ремонт стиральных машин siemens

4. How to Enter Fury Challenge

To enter you must (a) be eligible in accordance with clause 1 of the Rules, (b) agree to these Rules, and (c) hold a Fury account.

5. How to Win

Fury Challenge is exclusively a contest of skill to determine the best individual players and clans of Fury during the Contest Period based upon final Ladder (as defined below) position.

For Fury Challenge, we will operate 7 different ladders, comprised of: 4 ladders relating to individual performance; 1 ladder for each game type (Bloodbath, Elimination and Vortex), and 1 ladder based on overall performance in all 3 game types; and 3 ladders relating to clan-based performance (1 ladder for each of Elimination and Vortex game types, and 1 ladder based on overall Clan performance in both these game types).  The 7 different ladders are referred to collectively as the “Ladders.”

An individual entrant’s final position on any particular Ladder is based on his or her best-10 performances in the relevant game type over the course of the entire Contest Period.  For clarity, an entrant may play any particular game as many times as he or she is able during the Contest Period, and his or her best-10 performances in such game type will be used to determine his or her position on the relevant Ladder.

To be eligible to win a prize (based on either individual performance or clan-based performance), you must complete at least 10 games for that particular game type during the Contest Period -- for example, to be eligible for a prize based on your performance in the individual Bloodbath game type, you must complete at least 10 individual Bloodbath games during the Contest Period; and to be eligible for a prize based on your performance in the Vortex or Elimination game type, you must complete at least 10 Vortex or Elimination games during the Contest Period.  Wares Catalog of sites

You will not be eligible to win prizes for overall individual or clan-based performance unless you have completed at 10 games of at least one particular individual or clan-based game type.

We may post live Ladder standings during the First Contest Period and the Second Contest Period (and during the Mid-week Practice Period between the First Contest Period and the Second Contest Period), but only the final Ladder standings at the end of the Second Contest Period will determine Fury Challenge winners.

Each participant’s Avatar Rank (e.g., Disciple, Adept, Ascendant etc) within Fury will be capped from the start of the Practice Session through the end of the Contest Period, as determined by us in our sole discretion. The caps are the following:

Bloodbath: Rank 4
Vortex: Rank 4
Elimination: Rank 5

A player’s (or clan’s) score in any game is based on their skill rating versus their opponent’s skill rating (or the skill rating of their opponent clan), as determined using Auran’s implementation of the GLlCKO-2 system, or such other system or method as we may in our sole discretion determine.  Generally, defeating other individuals or clans will result in a better score than being defeated; defeating another player or clan with a high skill rating will result in a better score than defeating another player or clan with a low skill rating; and losing to a more highly rated player or clan will result in a better score than losing to a player or clan with a lower skill rating.

Clans for Fury Challenge may contain no more than 24 members.

6. Prizes

Prizes will be awarded to the top players on the 4 individual-based Ladders and the top clans on the 3 clan-based Ladders.

For each of the clan-based Ladders, prizes will be awarded to each member of the top finishing clans (up to the maximum permitted 24 clan members).  If a top finishing clan has less than 24 members, the remaining prizes for such clan will not be provided to such clan members and may be reallocated to other players at Auran’s discretion.  By way of example, if a winning clan has 18 members, each of the 18 will be awarded the relevant prize; the remaining 6 prizes which would have been rewarded -- had the winning clan had the maximum of 24 members -- may be reallocated to other top players at Auran’s discretion.

Specific prizes will be announced on www.furychallenge.com on or before the commencement of the Practice Session. All stated prize values reflect our good faith determination of the Recommended Retail Price (“RRP”), in US Dollars, of the relevant prize.

The total RRP value of all prizes that may be awarded equals US$1,000,000.00.

All taxes, duties, imposts or other fees associated with or relating to the receipt or use of any prize are the sole responsibility of the recipient.

We will pay for reasonable costs of delivery of physical prizes, provided that we will not procure or pay for any shipping insurance.  We will select the method of delivery of such physical prizes, and such prizes will be addressed delivered to the postal address listed in the relevant winner’s Fury account details.  Delivery will not be made to a PO box.  We are not responsible for any damage that occurs to any prize during shipment.

Awards of non-physical prizes (such as in-game gold) will be delivered by means of electronic code or other method selected by us to the email address listed in the relevant winner’s Fury account details.

We are under no obligation to distribute prizes if, in our reasonable opinion, there are no winners.  Circumstances in which we would not be obligated to distribute prizes include, but are not limited to, where (a) there is cheating by multiple or an indeterminate number of persons which makes it impossible to conclusively determine winners, or (b) there are technical, hardware, software, communications, network, connectivity or other problems which interfere or prevent Fury Challenge from operating as intended.

Prizes which are returned, undeliverable or not claimed within 1 month of delivery, attempted delivery or notification are forfeited.  Such prizes may, but need not, be awarded to the next highest ranked eligible player.

Prizes are not exchangeable, transferable or assignable.  Prizes are subject to availability.  We reserve the right to provide alternative prizes of comparable value if a particular prize is unavailable for any reason.  Prizes are not redeemable for cash.  Some prizes may only be redeemable by those who have purchased a valid license to the Fury software and established an account with us in accordance with the Terms of Use.

Certain prizes provided by our prize sponsors may only be awarded to persons residing in certain national or regional territories -- you are not eligible to receive these prizes if you do not live in the approved territory. 7. Notification of Winners

Winners will be notified by email, at the email address that the winners have registered with us during the Fury account sign-up process.  Results of Fury Challenge will also be posted at www.furychallenge.com. You consent to our posting of your username on www.furychallenge.com if you are a winner.

Prior to arranging for delivery of any prize and as a condition to being awarded any prize, we reserve the right to request that winners provide proof of eligibility (including, without limitation, confirmation of identity, and proof of age and place of legal residency).  We reserve the right to disqualify you if you do not comply with any such request in a timely manner.

8. Disqualification

We have the right to disqualify you from Fury Challenge if you: (a) fail to comply with any provision of the End User License Agreement, Terms of Useor these Rules [provide links]; (b) cheat or appear to have cheated while participating in Fury Challenge; (c) use a false email address; (d) tamper with the entry process or the operation of Fury or Fury Challenge (or any web site relating to either of the foregoing); (e) do not meet the eligibility requirements; or (f) behave in any other manner which is inconsistent with good sportsmanship generally (including, without limitation, by exploiting any feature, function, weapon, tool or ability in a manner which we determine in our sole discretion to be unfair to other Fury Challenge participants or otherwise inappropriate).

9. Our Determination is Final

As to all matters covered under these Rules (including without limitation determinations as to eligibility or disqualification, prize values and awarding of prizes), our determination may be made in our sole discretion and is final and binding.

10. Cancellation of Fury Challenge

We may suspend or cancel Fury Challenge or your participation, without notice to you, should any bug, virus, other harmful code, unauthorised intervention, glitch, technical failure, unexpected problem or tampering, or factor for which we are not responsible (or which is otherwise beyond our control) affect or in our opinion be likely to affect proper play of Fury Challenge or otherwise interfere with or prevent our running of Fury Challenge as planned by us.

11. Disclaimer

We, and our affiliates, agents and employees, are not responsible for: (a) Internet, electronic, hardware, software, network or other computer-related failures, malfunctions or errors; (b) any failure or malfunction in our scoring system; (c) any disruptions, damages, losses, failures or errors that are caused by events or occurrences that are beyond our control; (d) typographical, processing, mechanical or human errors; or (e) failed, incorrect, incomplete or delayed electronic communications regardless of how caused.

Without limiting the foregoing, the version of Fury that you will play during the Practice Session, the Contest Period or, if applicable, any Mid-week Practice Period is pre-release “beta” version of Fury that is incomplete and may contain inaccuracies or errors that could cause failures or other problems. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF FURY IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY AND PERFORMANCE IS WITH YOU.  TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FURY IS PROVIDED “AS IS”, AND WE DO NOT PROVIDE AND WE HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, IN CONNECTION WITH FURY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONDITION, OR NON-INFRINGEMENT.

WITHOUT LIMITING ANY OTHER TERM OF THESE RULES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL PRIZES ARE AWARDED “AS IS,” AND WE DO NOT PROVIDE AND WE HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, IN CONNECTION WITH ANY PRIZES AWARDED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONDITION, TITLE, NON-INFRINGEMENT, OR ANY WARRANTY THAT ANY PRIZE WILL OPERATE USING THE VOLTAGE USED IN THE ELIGIBLE LOCATION IN WHICH YOU LEGALLY RESIDE OR PLAN TO USE SUCH PRIZE OR OTHERWISE FUNCTION AS INTENDED.

12. Waiver

Without limiting any other term of these Rules, to the fullest extent permitted by applicable law, by accepting these Rules and participating in Fury Challenge, you hereby release us, and our affiliates, agents and employees (collectively, the “Auran Parties”), from any liability, and waive all causes of action against all Auran Parties and covenant not to make any claim against any Auran Party, in connection with or otherwise relating to your participation in Fury Challenge (including, without limitation, any use of any prize that may be awarded to you), including without limitation all claims, damages and liabilities relating to personal injury or death or damage to or destruction of personal property.

13. Other Terms

In addition to these Rules, your rights and obligations concerning Fury and Fury Challenge are governed by the Terms of Use, the Fury End User License Agreement, and the Privacy Policy. [provide links]  Please review each of these carefully, as you must agree to be bound by each of them before you may play Fury and participate in Fury Challenge.

For clarity, any personally identifiable information collected from you in connection with Fury Challenge will be held and used in accordance with our Privacy Policy.

Fury Challenge and these Rules are governed by the laws of Australia, and by participating in Fury Challenge you agree that any dispute or controversy between us relating to Fury, Fury Challenge or these Rules will be subject to the jurisdiction of the courts of Queensland, Australia and their courts of appeal.

14. Changes to these Rules

We reserve the right to update and change these Rules at any time. Please check these Rules each time you participate in Fury Challenge to ensure you are aware of any updates or changes.  You can determine if these Rules have been revised since your last visit by referring to the "Last Updated" date at the top of this page.  All changes to these Rules will be effective when posted, and your continued participation in Fury Challenge after the posting will constitute your acceptance of, and agreement to be bound by, those updates or changes.
